    Auction Terms and Conditions
    Conditions of Sale
    1.1. The following Terms and Conditions, constitutes the entire terms and conditions under which the property listed on this website https://bigbore.org are offered for sale by the Bigbore Association of Southern Africa (BASA) as Item/s on auction (“Auction”).
    1.2. As used herein, the purchase price shall mean the price at which an Item has been closed on (“Purchase Price”) by live auction at the designated shooting event (“Live Auction”), with the highest bid being the winning bid, to a Purchaser. No Additional fees or commissions are expected, however any storage fees, transport fees, licensing fees etc., will all be for the Purchaser’s account.
    1.3. Prior to the Live Auction, a pre-auction (“Pre-Auction”) will be held on this BASA website. The Pre-Auction will be held until 10am 27 September 2025, after which the Pre-Auction will be closed.
    1.4. The Live Auction will commence with the highest bid received on the Pre-Auction.
    1.5. All bidder’s registered on the BASA website and that have made a bid, or any additional interested parties, may contact BASA at +27 73 219 9278 and request to be added to an auction WhatsApp group (“WA Group”). The purpose of the WA Group is to allow any person/party who cannot attend the Live Auction, the follow the Live Auction by WhatsApp on the day of the Live Auction. The following will apply to the WA Group:
    1.5.1. BASA will use its best endeavors to relay the current bidding price at the Live Auction on the WA Group to all interested parties. The BASA communication number will be identified as one of the BASA exco members or their authorised agent/employees, unless indicated otherwise;
    1.5.2. Any party added to the WA Group, may then by sending a WA to said WA Group, at the time of the Live Auction, send a bid, which will be deemed to be valid on the Live Auction.
    1.5.3. Should said bid be the highest bid on which the bid may fall at the Live Auction, such person (or number allocated to the person, from which said bid was made) on the WA Group shall be deemed to be the winning bidder and Purchaser and be bound by the terms and conditions as contained herein.
    1.5.4. Any person who adds their number to the WA Group, joins the WA Group willingly and will be deemed to be a party to the Live Auction and the terms and conditions of the Auction. For avoidance of doubt, such person shall be deemed to be represented on said WA Group by his contact number and any communication/bid received by said number, shall be deemed to be the person, registered against said number;
    1.6. On Completion of the bids at the Live Auction, the highest bidder will have been deemed to have purchased the Item being offered (“Purchaser”) and to have:
    1.6.1. Assumed full responsibility and liability for the ownership of the Item in accordance with the terms and conditions contained herein;
    1.6.2. To settle the Purchase Price within a maximum of seventy-two hours from the end of the Live Auction.
    1.6.3. In the case of all firearms it is specifically recorded that the Purchaser is deemed to have assumed full liability for ownership and payment in accordance with the terms and conditions contained herein irrespective of the granting or not of a South African Police Services license or permit for possession of the Item that was auctioned.
    1.6.4. All items requiring licenses’ shall be retained by BASA pending proof of issuance of said licenses’.
    1.6.5. Should a license for the Item, for any reason whatsoever, be declined, then the Purchaser may require BASA or a registered arms and ammunition dealer of the Purchaser’s choice to resell such Item on the Purchaser’s behalf. Such sale shall be conducted against the prevailing terms and conditions of the chosen dealer at time of resale. It is specifically noted that BASA will in no way be held liable for any costs, fees, shortfall if any, between the Auctions Purchase Price and the resale price if the Purchaser chooses to resell the Item.
    1.6.6. Under no circumstances shall any Item requiring SAPS licensing be released to any person or body not duly authorized to be in legal possession of Item that was auctioned, and unless all monies due have been settled in full and in accordance with the terms and conditions contained herein. No Items shall be deemed to have been paid for until all monies due have been delivered in cash or in Bank Cleared funds.
    1.7. All parties making a bid on the Pre-Auction acknowledges, that should his/her bid be the highest bid on the Pre-Auction, and on the Live Auction a higher bid is not received, that bidder’s bid will be deemed to be the highest bid and that bidder will be the Purchaser and be subject to all terms and conditions as set out herein.
    1.8. All purchases may be paid for in cash, EFT or by Master Card or VISA. A premium of 5% will be levied for all Credit Card transactions. If the foregoing or any other conditions contained herein are not complied with by the Purchaser, BASA will have the right to hold the Purchaser liable for the Purchase Price, and then BASA at its sole discretion may:
    1.8.1. Not except the sale, retaining as liquidation costs any amounts paid by the Purchaser; and/or
    1.8.2. Resell the Item.
    1.9. All payments to be made within 72 Hours. Items sold at auction and not paid for in full within 72 hours from the date of the Live Auction, shall be deemed to be abandoned. BASA reserves the right to dispose of the Item in any manner it sees fit to recover reasonable administration and/or storage costs from the disposal of said property and/or the Purchaser. No subsequent claim arising from such a disposal shall be entertained by BASA, also may not be held liable for any losses incurred by the Purchaser, or any other party, in this regard either publicly or privately and in such event to hold the Purchaser liable for all costs including our commission and expenses for both sales, all other charges due hereunder (if applicable), Attorneys fees and incidental charges will be charged as Attorney to Client Charged.
    1.10. BASA reserves the right to have a reserve price on any item. BASA reserves the right to reject any bid. The highest bid acknowledged by BASA shall be deemed to be the final bid price. Our sale records shall be conclusive in any dispute during or after conclusion of the Live Auction. BASA accepts no liability for any losses of whatsoever nature caused by any legislative changes in regard to the possession, by individuals or bodies, of firearms or ammunition.
    1.11. If an item is offered subject to a reserve (this being the confidential minimum price required by the consignor) then BASA reserves the right to open the bidding or to bid on the consignor’s behalf in order to protect such reserve. BASA shall not bid on the consignor’s behalf above such reserve.
    1.12. All ITEMS are sold “Voetstoets”.
    1.13. These Conditions of Sale and the respective rights of the Purchaser and BASA, are governed by the laws of South Africa. By bidding at an auction in person, or by agent, order-bid or telephone or other means, the Purchaser or bidder agrees to be bound by these terms and conditions. Any dispute controversy or claim arising out of or relating to this Agreement, or the breach, termination or validity thereof, brought by or against BASA (but not including claims brought against the consignor by the Purchaser of the lots consigned hereunder) shall be resolved by the parties through mediation, then arbitration.
    1.14. These Conditions of Sale, shall bind the successors and assigns of all bidders and Purchaser’s and inure to the benefit of successors and assigns. No waiver amendment or modification of the terms hereof (other than posted notices or oral announcements during the Live Auction) shall bind BASA unless specifically stated in writing by BASA.
    1.15. Absentee Bids. As a service to those bidders that are unable to attend the actual auction, we may at our sole discretion accept bids in advance of sale by telephone, or in writing on the bidding forms provided on the website. In the event that identical absentee bids are received then the first bid received shall take preference.
